The Law Office of Steven C. Benke ("Firm," "we," "us," or "our") operates the website benkeimmigrationlaw.com (the "Site"). This Privacy Policy explains what information we collect through the Site, how we use and protect it, and the choices available to you. It applies to visitors, prospective clients, and users of our "My Case" client portal.

This Privacy Policy does not create an attorney-client relationship, and it does not apply to information you provide to us in the course of an existing attorney-client relationship, which is governed separately by the Texas Disciplinary Rules of Professional Conduct and applicable attorney-client privilege and confidentiality obligations.

Information We Collect

Information You Provide Directly

When you submit a contact or consultation request form, call our office, or use the My Case portal, we may collect:

  • Name, email address, phone number, and mailing address
  • Details about your immigration matter or legal question, including case numbers, receipt numbers, and immigration history
  • Communications you send us by phone, email, web form, or through the client portal
  • Any documents you upload or share with us in connection with your case

Our consultation and intake forms are hosted through a third-party form provider (forms.graphicgato.com). Submissions are transmitted securely and routed to our office.

Information Collected Automatically

Like most websites, the Site uses cookies, pixels, and similar technologies, including Google Tag Manager and Google Analytics, to understand how visitors use the Site. This may include:

  • IP address, browser type, device type, and operating system
  • Pages viewed, time on page, referring website, and general geographic location
  • Interactions with forms, buttons, and links on the Site

This information is collected in aggregate and is not used to identify you personally unless you have separately submitted identifying information through a form.

How We Use Your Information

We use the information we collect to:

We do not sell your personal information. We do not use information submitted through consultation or intake forms for unrelated marketing or advertising purposes.

How We Share Information

We may share information with:

  • Service providers who help us operate the Site, host forms, or manage the client portal, under confidentiality obligations consistent with those imposed on the Firm
  • Government agencies, courts, or opposing counsel, but only as necessary to represent a client and only within the scope of an attorney-client engagement
  • Professional advisors (such as accountants or auditors) where required by law

We do not share information with third parties for their own independent marketing purposes.

Receipt Numbers and Case Status Monitoring

If you are a client or prospective client, you may provide us with your USCIS receipt number(s) (the unique identifier assigned to a filed immigration petition or application). USCIS treats receipt numbers as Personally Identifiable Information, and we handle them accordingly.

We use receipt numbers to:

Query the official USCIS case status system and other authorized case-tracking tools to check and monitor the status of your petition or application Track Visa Bulletin priority dates associated with your case (for example, F2A petitions) Provide you with case status updates through the My Case portal or by direct communication from our office

We do not store or retain your receipt number in our databases or the My Case portal. When you provide a receipt number, it is transmitted via a secure, encrypted connection to query the official USCIS case status system in real time, and the number itself is not saved by the Firm afterward. Transmission occurs over encrypted channels, and access to the query tool is limited to Firm personnel and authorized service providers who need it to check your case status. Receipt numbers are never used for advertising or marketing purposes, are not sold, and are not shared with third parties except as necessary to perform the USCIS status query described above.

The My Case Client Portal

If you are a current client, you may be given access to the My Case portal to review the status of your matter. Access is limited to authenticated users, and information displayed in the portal is treated as confidential client information subject to the attorney-client privilege, in addition to the protections described in this Privacy Policy.

Cookies and Analytics

You can control or disable cookies through your browser settings. Disabling cookies may affect the functionality of certain features on the Site, but will not prevent you from contacting our office by phone or submitting a consultation request.

Data Retention

We retain information submitted through the Site for as long as necessary to respond to your inquiry, and, for clients, for the period required by our records retention policies and applicable Texas State Bar rules governing client files.

Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect information submitted through the Site. No method of transmission over the internet is completely secure, and we cannot guarantee absolute security.

Children's Privacy

The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13 through the Site.

Related Firm Websites

If you are directed to or from one of these sites, this Privacy Policy applies to the immigration law Site, and the corresponding policy posted on each affiliated site governs use of that site.

These Terms of Use ("Terms") govern your access to and use of benkeimmigrationlaw.com (the "Site"), operated by The Law Office of Steven C. Benke ("Firm," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

No Attorney-Client Relationship

Use of this Site, submission of a contact or consultation request form, or communication through the Site does not create an attorney-client relationship between you and the Firm or any of its attorneys. An attorney-client relationship is formed only when the Firm expressly agrees to represent you, typically through a signed engagement letter.

Do not send confidential or time-sensitive information through the Site's general contact forms until an attorney-client relationship has been established. The My Case Portal

Access to the My Case client portal is limited to individuals with an active engagement with the Firm and valid login credentials.
